The Officers refused his request. A few hours later, Plaintiff was then transported to Bronx Lebanon Hospital, where they performed x-rays on his eyebrows, in which he received stitches and a cat-scan on his back. Plaintiff was then held in unlawful police custody for approximately 36 hours and charged with reckless endangerment, criminal possession of a controlled substance, resisting arrest, and reckless driving. Defendants approached Plaintiff at the passenger side door of his friend's vehicle, and communicated to Plaintiff that they were being stopped because of a cracked windshield. Plaintiff was demanded to exit the vehicle, and when asked as to why he was being ordered to exit the vehicle, defendants responded that they did not need a reason for their conduct and furthermore, said defendants threatened Plaintiff that they were going to employ excessive force via the use of a taser gun on Plaintiff if he did not exit the vehicle. When Plaintiff again questioned the defendants, the defendants unleashed a physical assault on Plaintiff's person by using a taser gun on him twice in the back, causing Plaintiff to fall out of the vehicle unto his knees and then to forcefully come into contact with the street as he fell to the ground. Then defendants accused the plaintiff of a criminal offense and illegally seized the plaintiff. As the plaintiff laid upon the ground defenseless, defendants proceeded to violently contort plaintiff arms behind his back so that they could apply metal handcuffs disregarding Plaintiff's complaints that the cuffs were placed on too tightly causing him significant discomfort and pain. Defendants ignored all of plaintiff's pleas to loosen the handcuffs, which resulted in plaintiff's wrists and hands sustaining loss of feeling, redness, and swelling. Defendants then proceeded to conduct an illegal search of Plaintiff and Plaintiff's friend's vehicle. Defendants then Plaintiff in an ambulance, fully cuffed and shackled, and transported him to the Bronx-Lebanon Hospital Center where he was treated for his injuries sustained as a result of this incident, including the removal of the prongs from the taser gun, and then, Plaintiff was transported to the 44th Precinct against his will. Plaintiff was fingerprinted, photographed, searched or strip-searched, and, without the presence of his counsel, interrogated Plaintiff before placing him in a dank and dirty cell where he was illegally detained against his will for approximately one (1) hour before being released with a desk appearance ticket. The defendants signed and forwarded the criminal court complaint against Plaintiff, in which they knowingly affirmed the truth of the fabricated allegations against plaintiff. Shortly thereafter Mr. Williams saw a photograph of the person subject to the arrest warrant and saw that it was not a photograph of him.\n\nWhile in unlawful custody, Mr. Williams was required to show tattoos present on his body, which he did. However, even though the tattoos did not match the individual who was the subject of the arrest warrant. Mr. Williams was not immediately released from custody. Upon insisting that he was not the person who was the subject of the warrant, Mr. Williams was charged with false personation, transported, in restraints, to a prison in Manhattan known as ‘the tombs’ and then transported to the Rikers Island Correctional Facility where his detention continued.
