PO Awani asked one of the Plaintiffs if he had smoked marijuana. When the Plaintiff said “no”, PO Awani stated, inter alia, that he knew that Plaintiff was lying and that he would punch him in the face if he kept lying to him. Plaintiff had not lied. PO Valdez searched the car, without consent and without a warrant. PO Valdez also questioned the second Plaintiff, asking if he had smoked marijuana, and asked whether he was lying when he too denied having smoked marijuana. Both Plaintiffs were handcuffed, and in connection with that, POs Charlie Little and John Does (the names John Does are fictitious, as the true names of these officers were unknown at the time of the complaint) arrived at the scene in a second and third police car. PO Little removed one of the Plaintiffs from the police car, and strip searched him; he took the Plaintiff’s clothes off and, in the middle of a public street and in view of the public, picked up Plaintiff’s penis and his testicles, and spread his buttocks, to check if he had any contraband underneath his penis and testicles or inside his buttocks. Plaintiff possessed no contraband. PO Awani strip searched the other Plaintiff in a similar way, upon which he found something between the second Plaintiff’s buttocks. PO Doe then said, in sum and substance, “oh, it looks like we’re dealing with two little faggots”. \n\nBoth Plaintiffs were taken to the precinct. One of them complained that the handcuffs were too tight, but the officers refused to alleviate the excessive tightness of the handcuffs. At the precinct, it was discovered that the object found between one of the Plaintiff’s buttocks was a marijuana cigarette. That Plaintiff was later charged, based on PO Awani’s lie that he had observed Plaintiff, in plain view, to have marijuana in his hand. All charges against that Plaintiff were later dismissed in their entirety on October 26, 2012. Although marijuana had only been found on one Plaintiff, the other Plaintiff was issued a Desk Appearance Ticket and was charged with possession of marijuana.
