The automobile had original factory tinted windows. Defendant was backing another automobile into a parking space on the street, which came close to contacting Plaintiff's vehicle, causing Plaintiff to signal once with his automobile's horn. Defendant in uniform, responded by getting out of his car, standing up and yelling at Plaintiff: \"Do you know who 1 am?' Plaintiff responded by informing Officer Ortiz that he was blocking traffic and Plaintiff continued on his way. Later that day, at 4:00PM, at Broadway and Nagle Ave, Manhattan, Plaintiff, still driving the same vehicle, was stopped by defendant who was operating a NYPD automobile. Defendant approached Plaintiff's driver side window and immediately asked for Plaintiffs license, registration and insurance card, telling Plaintiff he was stopped because of the automobile's tinted windows. Plaintiff asked defendant if he would show him the meter that the NYPD uses to measure the percentage of the tint of the windows to determine their legality. Defendant did not have a meter with him and never measured the tinted windows in any way. Defendant responded by getting visibly angry and demanding Plaintiff's license, registration and insurance card. Defendant then opened the driver's side door, unbuckled Plaintiff's seatbelt, violently pulled Plaintiff from the automobile and slammed Plaintiff face first onto the pavement. Defendants detained plaintiff and placed him in handcuffs. Defendants escorted plaintiffs to the 34th Precinct. Plaintiff was searched and detained in a holding cell before defendant issued a summons to Plaintiff and released him.
