The Hispanic individuals became hostile and aggressive. Officer KEVIN LO heard and observed the altercation but did not approach the Hispanic individuals, failing to intervene. At this time URBINA was frisked multiple times with no justification. The group was forced into TEJADA’s apartment, TEJADA was forced into the apartment at gunpoint. While in the apartment, police officers frisked LISBY. TEJADA explicitly did not consent for the Officers to enter his apartment but they entered anyways forcibly and searched with no justification.\n\nDuring the search, TORRES, SCOTT and URBINA were directed to leave the apartment in the Police Officers’ custody. The police officers placed LISBY and TEJADA by the front of the building where TEJDA was wrongfully charged with a disorderly conduct offense. The Police Officer, believed to be a captain, told TORRES, SCOTT and URBINA to leave the area and brandished his baton. TORRES head was propelled into the glass of the storefront by the police officers. Police Officers then handcuffed TORRES and placed him in a police vehicle. As SCOTT and URBINA were forced to leave the area under constructive custody, they were struck and beaten by individuals believed to be the Hispanic individuals from the previous encounter. All Plaintiffs committed no criminal or any other offense under the law to justify any stop and detention or arrest and/or to justify the utilization of the unreasonable, unnecessary and excessive force applied. SCOTT and URBINA were placed in immediate danger were directed to leave the area, causing them to be attacked.
