The police were called to the party for reasons unrelated to the Plaintiff. PO Marcus Rivera and PO Anthony Varrone arrived at the scene where Plaintiff was in the driver's seat of his car with his girlfriend in the passenger seat. Plaintiff ignored PO Rivera's direction not to exit the vehicle. PO Rivera, PO Varrone, and PO \"John Doe\" began kicking and punching Plaintiff, including in the face. PO Rivera then deployed his taser onto Plaintiff. Plaintiff was arrested, handcuffed and transported to the local precinct. Plaintiff was processed, detained for a time, and then transported to Central Booking. PO Rivera and PO Varrone maliciously supplied false information to the DA's office, instigating the commencement of the criminal prosecution of the Plaintiff. At arraignment bail was set but Plaintiff was unable to post bail. He was therefore detained at Riker's Island for 48 hours until he could post bail.
