Plaintiff was in the front passenger seat of his cousin, Issam Hamadan's uncle's car. The car was previously damaged in an unrelated event, and the license plate was visible and legible on the windshield. Mr. Hamadan exited the car to enter a store on 3rd avenue and to avoid receiving a citation, Plaintiff moved into the driver's seat, however, he never drove the car. When the NYPD pulled up to the parked vehicle, they told Plaintiff to move the car, but didnt because he doesnt know how to drive shift. The police officers said a racial comment and took the phone out of plaintiff's hand, tossed it and damaged the phone. Plaintiff was then handcuffed. \n\nPlaintiff was arrested for having improper displays of plates, obstructing governmental administration in the second degree and disorderly conduct. He was taken to the 68th precinct and they were so difficult to remove that it took police officers 30 minutes to finally take them off.
