Because this was a common form of police harassment in plaintiff's neighborhood, he began legally videoing the interaction and did not interfere with the situation in any way. When defendant officers noticed, they aggressively grabbed the plaintiff's arm and told him to leave, to which the plaintiff complied with. However, as the plaintiff walked away, defendant officer Rios approached him from behind, grabbed, pushed, punched, choked and pepper sprayed the plaintiff. Rios then arrested the plaintiff without reasonable or probable cause, but instead because of the plaintiff's recording and monitoring of the defendant officers' conduct. \n\nThe plaintiff was transported in shackles to a hospital to treat his injuries following the battery and assault. After, he was taken back to a precinct whereby the defendant officers maliciously commenced criminal proceedings against him, falsely stating that the plaintiff had resisted arrest and engaged in disorderly conduct.
