The officers stopped the plaintiff while he was lawfully present in the above listed location and unlawfully questioned him without any legal justification. They falsely accused the plaintiff of committing Criminal Possession of a Controlled Substance in the Fifth Degree, Criminal Possession of a Controlled Substance in the Seventh Degree, Criminally Using Drug Paraphernalia in the Second Degree, and Unlawful Possession of Marijuana. The officers unlawfully searched plaintiff by rifling through his pockets and patting him down all over. The officers violently contorted the plaintiff's arms behind his back and applied metal handcuffs to his wrists in an excessively tight manner. Plaintiff repeatedly requested that the defendant officers loosen the handcuffs, which caused substantial pain and discomfort, bruising, swelling, contusions, severe discomfort, extreme emotional distress, and psychological trauma. Defendant Officer Walsh signed a criminal complaint against the plaintiff in which he knowingly affirmed the truth of fabricated allegations against the plaintiff. On August 29, 2019 and May 14, 2020, all charges against the plaintiff were dismissed. Defendant Officers Walsh, Reed, and Lodispoto arrested and caused a criminal prosecution to be initiated against the plaintiff because of their desire to use plaintiff's arrest and criminal prosecution to incur additional overtime compensation, benefits and favor from superior officers, to avoid consequences associated with failing to meet NYPD departmental arrest quotas, and to conceal their egregious violations of proper police procedures and fabrications of non-existent evidence.
