Plaintiff was lawfully operating his motor vehicle when officers approached Plaintiff’s car with weapon drawn and ordered him to get out of his vehicle. POs then grabbed Plaintiff by the belt loop of his jeans and dragged him to the trunk of Plaintiff’s car, slamming him against it. An officer conducted an illegal search of Plaintiff's vehicle, and retrieved a pocket utility knife from the bottom of Plaintiff’s center console. The officers arrested Plaintiff, without the requisite probable cause, and without telling him why he was arrested. Plaintiff was subject to verbal and physical abuse and intimidation from POs. After Plaintiff had been brought to the precinct, where he was held in custody for approximately three hours, Plaintiff was eventually issued a desk appearance ticket and released. Plaintiff was charged with alleged possession of an illegal “gravity knife”. Plaintiff was suspended from his jobs while the case was pending.
