Two defendants, NYPD officers Dustin Diaz and Mark Whirl gave conflicting accounts of what led to their decision to arrest the plaintiff, and based on this NYPD officers maliciously prosecuted the Plaintiff. There were also video recordings of the incident, and these videos undermined Defendants' account.
