The Plaintiffs and the Trespasser called 911 on each other. On February 7, 2019, the trespasser went to the precinct to falsely report an unlawful eviction by the Plaintiffs and that the Plaintiffs had a gun and were selling marijuana. Without investigating, NYPD officers went to the Plaintiffs' home and demanded entry. One of the Plaintiffs told them to bring a search warrant and over the course of 15 minutes, told them multiple times they did not have consent to enter. The Plaintiff tried to close the door and tried to cease the voluntary conversation with the police. Defendant NYPD Officer Damon Martin became frustrated, put his boot in the door, and told the Plaintiff he was going to arrest her. The officers all went into the apartment, arrested the other Plaintiff, and began unlawfully canvassing and searching the residence. The Plaintiff repeated stated the entry was unlawful. Defendant NYPD Officer Manny Sharma went into the Plaintiff's bedroom at the back of the home, threw clothing from the bed, and found a small amount of marijuana. Although it was in a location and quantity insufficient to be illegal under state or federal law, the Defendants put the Plaintiff into overly tight handcuffs, which the Defendants refused to loosen. The Defendant NYPD Officers continued to search the apartment for an additional half hour. On February 8, 2019, Defendant Sharma applied for a search warrant of the Plaintiffs' residence before the court, with materially false statements regarding the nature of the entry and search that took place. These were shown to be lies through body worn camera footage. The Plaintiffs were in custody for 48 hours before being arraigned.
