He sustained several injuries, including a concussion and a bloody wound that required stitches. Mr. Abraham immediately told the defendants that he had been injured and required medical attention. However, they continued driving, making four or five other stops and detaining six other people, all of whom were also placed into the van without seatbelts. Detective DeJesus wore plain clothes, grabbed Plaintiff by the sweater and asked, without any reasonable suspicion, if he just robbed someone. Detective DeJesus then told Plaintiff he matched the description for a robbery that just occurred, confiscated his cellphone and unlawfully searched his pockets, including pulling down his sweat pants to search his shorts. Despite, no drugs, weapons or other contraband found on Plaintiff, he was handcuffed and unlawfully arrested, presumably in connection with the robbery. Additional plain clothes police officers arrived at the scene and after a few minutes, Plaintiff was escorted to the back of a prisoner van. While in custody in the prisoner van, Detective DeJesus attempted to associate Plaintiff with another individual who had just been arrested for marijuana possession. Plaintiff remained in the prisoner van for 4-5 hours and was unlawfully searched again by NYPD Detective Tarah Barrett during a stop at the 9th precinct. Again, no contraband was found. During Platintiff's time in the van, Defendant's mistreated Plaintiff including (i) name calling and excessive use of profanity and (ii) blowing smoke in his face despite being asthmatic. Ultimately, the Plaintiff was brought to the 10th precinct where he was charged with criminal sale of marijuana in the fourth degree, a crime he did not learn of until he was on the way to central booking.  At the 10th precinct he was again subject to a search, this time a strip search by Detective DeJesus which lasted several minutes. On September 2, 1024, Detective Barrett executed a criminal complaint against Plaintiff charging him with three untrue misdemeanor offenses and produced knowingly false and perjured statements around the arrest such as observing the plaintiff handing a separately charged person an object in exchange for US currency. Due to the false charges, Plaintiff was arraigned and spent approximately 27 hours in police custody. NYPD Detectives unlawfully arrested and searched Plaintiff and was arraigned on false charges.
