When Plaintiff pulled up in front of his home, defendants, NYPD officers approached his car with their guns drawn. Plaintiff scared honked his car to alert his family. Plaintiff's father exited the house and then Plaintiff opened the car door and when he did the NYPD officers John and Jane Does, Dustin Diaz and Mark Whirl dragged him out of his car and physically assaulted him, causing injuries to his body and face and then arrested him. Plaintiff was also tasered and struck. Defendants hit plaintiff's head, pounded his head and body into the street. Plaintiff was also wrongfully arrested. The criminal charges were dismissed on August 12, 2024. Two defendants, NYPD officers Dustin Diaz and Mark Whirl gave conflicting accounts of what led to their decision to arrest the plaintiff, and based on this NYPD officers maliciously prosecuted the Plaintiff. There were also video recordings of the incident, and these videos undermined Defendants' account. Upon plaintiff's arrival, the defendants showed him a picture of his nephew, Ray Ray, and demanded to know who Ray Ray was.  Plaintiff responded that Ray Ray is his nephew and asked defendants if they had a warrant.  Defendants refused to show plaintiff a warrant, at which time plaintiff asked the defendants to leave.  Defendants refused and plaintiff took out his cell phone and began recording the defendants.  Officer Theobold then seized and handcuffed plaintiff and brought him out into the hallway.\n\nIn the hallway a Chinese person, who may have been the victim of a robbery by two men, was present.  Plaintiff was arrested at this time, despite the fact that he was not identified as one of the two individuals who had robbed the Chinese person.  Plaintiff was subsequently held in jail for approximately one day before being arraigned on robbery and other charges and released. Outside of the precinct Defendants NYPD officers Sherrianne Reinhardt and Officer Adrian Theobald had the Plaintiff exit the car. As Plaintiff was explaining to Defendants what happened, Reinhardt pushed Plaintiff against a gate which caused Plaintiff's foot to be stuck in the gate. The officers then pushed Plaintiff onto the floor. Other Defendants, NYPD officers Brenden Lavelle and Officer John Doe came and all the officers were on top of Plaintiff striking her about the head, face and body and dragged Plaintiff into the precinct and threw her onto the floor. Plaintiff passed out for about 20 minutes and when she awoke, there was an officer sitting on her right leg. Plaintiff asked for medical care, but was denied by the Defendants, but then Plaintiff was taken 7 hours later to Woodhull Hospital for medical care and was diagnosed with a farcture of the shaft of fibula with tibia and a closed head injury. Plaintiff was also subjected to verbal and physical abuse by defendants, and Plaintiff was also handcuffed and detained by members of the NYPD.
