Caneda, Luis Diaz and Carmen Caneda, were in bed at home when Jose and Luis's sister, K.A., answered the door to police officers, some in uniform and others plain clothed, who entered sans identification and a warrant. They handcuffed and dragged Jose L. Caneda to his couch. Jose was interrogated by the defendant about the whereabouts of his brother, Jose G. Caneda,  and was threatened to have his mother and sister taken to jail if he failed to cooperate. The defendants then confiscated Jose L.'s, Carmen's, and K.A.'s cell phones for Jose G.'s phone number and later searched Jose L.'s room. Jose L.'s bed was damaged and $850 was confiscated. Three hours later, an unnamed officer and search warrant arrived after finding Jose G. At 9:00 AM, plaintiff Luis Antonio Diaz was called to the scene and handcuffed alongside his brothers. The defendants never stopped searching the home at this time. Luis was denied to his inhaler after an asthmatic episode. Jose L. was denied access to a toilet. Six hours after the initial police entrance, the plaintiffs were taken to the 47th precinct.  Luis was sent home without a charge. Jose L. was taken to Riker's but released on $15,000 bail. He was charged with criminal possession of a controlled substance in the third degree, criminal possession of a controlled substance in the fourth degree, criminal sale criminal sale of marijuana in the fourth degree, and criminal possession of marijuana in the fifth degree.
