Joseph Morovich, Haley, and McCormick (first names unknown) pulled up next to him in a police car and told him to stop. POs Morovich and Haley got out of the car, and Morovich grabbed plaintiff, handcuffed him extremely tightly, and asked what he had in his pocket. Plaintiff answered that he had a box cutter in his pocket. PO Morovich searched him, including down his pants and touching his penis. Morovich removed the box cutter as well as two cellphones, then stated he had searched plaintiff due to seeing a bulge in his pants. Plaintiff repeatedly asked why he was being arrested, and PO Morovich told him not to ask questions and grabbed him roughly by the neck. PO Haley told plaintiff to shut up. PO Morovich then brought plaintiff over to the police car, and PO Haley grabbed his handcuffs from inside the car and pulled him in, causing him to hit his neck on the roof of the car. PO Morovich slammed the door on plaintiff's legs. Plaintiff asked for medical care, and PO Morovich responded by pulling out a can of pepper spray and threatening to spray plaintiff, as well as balling a fist and threatening to punch him in the mouth. At the 25th precinct, Morovich again searched plaintiff's pants and underwear, and found $100 of marijuana. Morovich strip-searched Morovich in a cell. Plaintiff again asked for medical treatment, and Morovich stated that if plaintiff went to hospital, his time in custody would be prolonged. Plaintiff was charged with criminal possession of a controlled substance in the fifth degree and unlawful possession of marijuana. The criminal complaint signed by PO Antonio Pagan falsely alleges that Morovich also found 3 bags on cocaine on plaintiff.  All charges against plaintiff were dismissed in March 2012. Police Officer Manuel Encarnacion, Sergeant Joseph McKenna and Police Officer Joseph Morovich pulled up in a marked patrol car and ran toward plaintiff to stop and frisk him. In response to plaintiff’s exercise of free speech, one of the defendants, likely Morovich, slapped plaintiff in the face. The defendants arrested plaintiff, handcuffed him excessively tight and brought him to an unknown precinct. In the precinct, the aforesaid defendants, acting in concert with Officer Stephen Hillman, falsely charged plaintiff with felony possession of a firearm. Plaintiff was eventually taken to Manhattan Central Booking. While plaintiff was held in Manhattan Central Booking, Officer Encarnacion, Sergeant McKenna and Officer Morovich, acting in concert, initiated a prosecution against plaintiff or played a role in initiating a prosecution against him by causing Officer Hillman to misrepresent to prosecutors that plaintiff had thrown a black bag to the ground that contained a loaded firearm. Plaintiff was held in the custody of the New York City Department of Correction (“DOC”) for approximately 25 days.  While in the custody of the DOC, plaintiff was strip searched on numerous\noccasions and was attacked by another inmate. On July 11 or 12, 2011, plaintiff posted bail and returned to court numerous times until the Manhattan District Attorney’s Office dismissed the case on September 5, 2012.
