Plaintiff was arrested without being read his Miranda rights, placed in handcuffs and leg shackles and transported to the precinct where he was placed in a holding cell with black mold that aggravated his asthma. The handcuffs and leg shackles were overtightened and caused cuts, bruising, loss of circulation, and nerve damage. Plaintiffs possessions were inventoried and never returned upon his later release.\n\nOnce at the precinct, plaintiff suffered an asthma attack and was transported to the emergency room where he remained shackled and in extreme pain from the tightness of the shackles. Sergeant Fontana refused to loosen the shackles after his release from the emergency room saying \"[Plaintiff] was going to learn a lesson.\"\n\nPlaintiff was transferred to central booking on May 7, 2014 and held in a cell with 20 other male prisoners. Plaintiff was assaulted by one prisoner and sustained a fractured nose and injuries to dental implants. Office Doe mocked plaintiff's injuries and threatened to put the plaintiff and the other prisoner in a cell so they could fight it out while the corrections officers bet on the fight. Plaintiff requested to use the pay phone to report the assault, but the corrections officer's refused. Instead the officers either hit the plaintiff with the receiver or gave the receiver to the other prisoner to hit the plaintiff. Plaintiff was transported to the ER for his injuries.\n\nPlaintiff was held on bail in the detention complex for 12 days, during which he suffered asthma attacks and was prevented from going to the infirmary. Officer Montague taunted plaintiff during this time.
