Plaintiff opened the front door of the apartment building slightly to explain to officers that her neighbor was not home and she did not consent to their entry without a warrant. The officers pushed open the front door, causing Plaintiff to tumble back and fall. Sergeant Bowe handcuffed Plaintiff for approximately 30 minutes and gave Plaintiff a summons charging her with disorderly conduct. Plaintiff complained that the handcuffs were too tight. The summons was dismissed on October 29, 2015. That day, Plaintiff was walking home, when an armed man in plain clothes jumped out of a car and shouted at Plaintiff: “Come here fucker!”. Plaintiff was frightened and unsure of who the man was so he ran to his aunt’s nearby house. The car followed him, and when Plaintiff was at his aunt’s door, three men, two with guns pointing at him, approached Plaintiff. Terrified for his life, Plaintiff placed his hands in the air. It turned out that the men were police officers. Officers tackled Plaintiff to the ground, dragged him, and punched him in his ribs, neck and the back of the head. One of the officers stomped Plaintiff’s head into the concrete rendering him unconscious. \n\nWhen Plaintiff regained consciousness, he was in handcuffs on the curb. The officers then asked him where the drugs were and one of the officers told Plaintiff “You going to run from a white person?”. More police cars were called to the scene. The police searched the area for weapons and contraband, and did not find any. Nonetheless, officers arrested Plaintiff without legal basis. At the precinct, he was strip-searched and issued a Desk Appearance Ticket. P.O. Quinto maliciously provided false information to the DA’s Office. On May 23, 2013, the ticket was dismissed for being legally insufficient.
