Two individuals arrived across the street, one of which shot a handgun approximately five times into the crowd on Morrison Avenue, while the other stood behind him. The crowd scrambled for cover, and the shooter and accomplice fled the scene. The five year old girl was struck in the lower abdomen by a bullet, and Jonathan Baez and Hector Lopez-Vega were shot as well. Brian Perez called 911 to report the shooting, and told the operator that both the shooter and accomplice had long hair. P.O.s arrived on the scene and secured the crime scene. Officers began canvassing the area for witnesses and the perpetrators. The perpetrators were described as two male Hispanics, approximately 5 ft 8 inches tall,  both with long hair in a ponytail and no facial hair, and one of them wearing a gray sweater and jeans. \nOn or about June 8, 2011, Brian Perez was shown a photo array prepared by Detective Acosta, which contained an April 26, 2011 police photograph of Plaintiff. The photograph depicted Plaintiff with a closely-cut, shaved Caesar style haircut and prominent, fully grown beard. Brian Perez identified Plaintiff as the May 27th shooter and indicated that Plaintiff shot a gun with both hands. On June 10, 2011, Plaintiff arrived at Bronx Criminal Court for a court appearance regarding his June 7, 2011 arrest for alleged criminal possession of marijuana. Detectives approached Plaintiff at Bronx Criminal Court and asked him his name before taking him to the precinct for questioning. Plaintiff told Detectives that all he knew of the May 27 shooting was what he had heard on the news, and that he had been with friends in a different neighborhood at the time of the shooting. Plaintiff was interrogated for several hours. Some detectives told Plaintiff they knew he was not responsible and would let him go if he provided them with names. Others accused Plaintiff of being a perpetrator, claiming they had the other perpetrator in custody who had admitted to committing the crime with Plaintiff. Detective Diedrick grabbed Plaintiff by the neck and threw him against the wall several times. The interrogation lasted about ten hours, during which time Plaintiff had one armed handcuffed to the wall. He was denied requests to call his family, denied food and water, denied requests to use the bathroom, and was kept in a freezing cold room. \nOn June 10, 2011, Brian Perez identified Plaintiff from a lineup arranged by Detective Diedrick and was taken to Central Booking. Plaintiff was charged with three attempted murders, denied bail, and sent to Rikers Island. Word spread at Rikers that Plaintiff was accused of shooting a five-year-old girl, which led to Plaintiff being abused by person guards and inmates. \nOn or about September 7, 2011, the D.A.’s office presented their case against Plaintiff to the Grand Jury. Plaintiff was indicted on charges related to the shooting, though the only information presented to the grand jury connecting Plaintiff to the event was the testimony of Brian Perez. ADA Takantzas failed to tell the grand jury that Perez had originally described the shooter and accomplice as having long hair. The D.A.’s office continue to deny requests for discovery made by Plaintiff’s defense counsel. On or about March 30, 2012, Plaintiff’s counsel received information that Perez wished to recant his identification of Plaintiff as one of the shooters. Plaintiff’s counsel provided ADA Takantzas with this information. On or about April 5, 2012, a bail hearing for Plaintiff was held, wherein Judge Steven Barrett directed ADA Takantzas to provide Plaintiff’s counsel with all outstanding discovery and Brady material regarding Plaintiff’s case. The bail hearing resumed on May 11, 2012, wherein Plaintiff’s counsel learned that ADA Takantzas had provided Judge Barrett with a confidential written submission. Plaintiff’s bail was denied. \nOn February 20, 2013, Plaintiff was assaulted by inmates and Corrections officers and suffered multiple fractures to his face and other injuries. Perez was later arrested for murder and other charges.
