Defendant Officers Joseph Loporto and Aaquib Bhatti informed Plaintiffs that they were being pulled over because the windows of their vehicle were illegally tinted. However, this was not true - it was a pretext to search the vehicle and the Plaintiffs. \nPlaintiff Byrd nevertheless complied with Defendant's requests for his license and registration, which Defendants took. Defendants returned after a moment and asked that the Plaintiffs exit the vehicle. While Plaintiffs were complying, one of the Defendant officers reached inside the vehicle to forcefully pull Byrd out of the car.  Defendants proceeded to search the car and both Plaintiffs without cause. Defendants claimed to have recovered an illegal knife on Plaintiff Williams, but this was not true. However, Defendants nevertheless arrested Plaintiff Williams and took him to a local precinct.  Plaintiff Byrd was allowed to leave the scene and was not arrested. \nPlaintiff Williams was transported to Central Booking and placed in a cell to await arraignment. At approximately 6:30PM on November 5, 2023 was arraigned for Criminal Possession of a Weapon in the 4th Degree. Defendant Loporto, in his capacity as an investigating officer, fabricated evidence against Plaintiff Williams and provided it to prosecutors, which directly resulted in Plaintiff Williams being deprived of his liberty. Without probable cause or legal justification, the officers forcefully removed Mr. White from his vehicle, physically assaulted him, and falsely accused him of a criminal offense. Mr. White was punched, elbowed, and subjected to an invasive search before being handcuffed tightly, causing him pain. He was then taken to the precinct, fingerprinted, photographed, strip-searched, and detained without being read his Miranda rights or provided with legal counsel. He was held in unsanitary conditions at the precinct and Central Booking for three days until his release on March 1, 2021. Officer Bhatti filed a criminal complaint falsely accusing Mr. White of narcotics possession and sale, leading to Mr. White's unlawful detention. The charges were eventually dismissed and sealed on April 14, 2022. Plaintiff was then transported to Kings County Central Bookings and held there.\n\nDue to the false statements of Defendant Officers, plaintiff was falsely charged with numerous crimes, and was then released from custody on November 30, 2021. Defendant suffered vision loss for several weeks and had to seek medical treatment.
