There was no indication that Plaintiff Cato had weapons or presented a threat to anyone nor was there any probable cause or justification behind Defendants actions. However, Defendants punched Plaintiff Cato in the eye and caused him to become unconscious. Defendants then searched, assaulted, punched, kicked, and placed in tight handcuffs. Plaintiff was hospitalized because of the injuries he received at the hands of the Defendants. Defendants transported Plaintiff Cato to the NYPD 113th Precinct, Queens County Central Booking, Eastern Correctional Facility, and Riker's Island Correctional Facility. As a result of the Defendants' actions, Plaintiff Danee Cato was deprived of his liberty, maliciously prosecuted due to the Defendants making false allegations that Plaintiff Cato committed criminal acts to the District Attorney's office and  detained for four years and eight months. On July 19th, 2019, the Appellate Division, Second Department dismissed Plaintiff Danee Cato's charges. Defendants' acts resulted in Plaintiff Cato facing physical injury, physical pain and suffering, emotional trauma and suffering, fear, embarrassment, humiliation, emotional distress, frustration, extreme inconvenience, anxiety, loss of liberty, and harm to his reputation. Plaintiff Cato believes he was targeted due to his race.\n\nOn June 11th, 2015, at approximately 1:00 p.m., Defendants--NYPD Police Officers Adam Georg, Robert Bracero, and John or Jane Does 1-10--illegally stopped and questioned Plaintiff Jahmarley Jones in the vicinity of 96-02 Rockaway Boulevard, in Queens, New York without any valid reason to suspect that Plaintiff Jones did any criminal act or a valid warrant. Defendants then physically restrained and removed Plaintiff Jones from the scene by excessively tightening handcuffs on him in an excessively tight was Defendants then transported Plaintiff Jones to the NYPD 113th Precinct by forcibly grabbing his person and shoving him into a police transport vehicle. Defendants criminally prosecuted Plaintiff Jones in varying ways such as scanning, fingerprinting, and invasively searching his body. Defendants later transported Plaintiff to Queens County Central Booking, and then Riker's Island Correctional Facility, where he was held for approximately four years. Defendants' false allegations to the District Attorney's office led to his malicious prosecution for criminal conspiracy to commit murder.  However, on February 15th, 2018, the Appellate Division Second Department reversed Plaintiff Jones' criminal court conviction. Ultimately, Defendants' actions caused Plaintiff to suffer physical injury, physical pain and suffering, emotional trauma and suffering, fear, embarrassment, humiliation, emotional distress, frustration, extreme inconvenience, anxiety, loss of liberty, and harm to his reputation.
