Returning to his apartment, plaintiff saw a group of police officers, including defendants, yelling at his father. As plaintiff approached his apartment, one of the officers grabbed plaintiff and twisted his arm behind his back. Plaintiff’s asked the officer why he was being grabbed. The officer told plaintiff that he was resisting, then threw plaintiff to the ground. Plaintiff fell to the floor face first. A neighbor offered to bring plaintiff a pair of shoes. One of the defendants shoved her forcefully away. Plaintiff was taken to the precinct. At the precinct, the officers falsely informed employees of the Queens District Attorney’s Office that they had observed plaintiff committing the crimes of Obstruction of Governmental Administration and Resisting Arrest. At no point did the officers observe plaintiff commit any crime. Plaintiff was taken transported to Central Booking and was arraigned in Queens County Criminal Court. Plaintiffs are a 59-year old woman and her 21-year-old daughter, both without any criminal record. That day, numerous officers were in front of the plaintiffs' house, slamming the mother plaintiff's son's head into a police car. Concerned for her son's safety, the mother plaintiff went outside to object to the physical assault. Officer Matthew Mauro then physically assaulted her by punching her in the head. She was then arrested by officers Mauro and Orlando. Hearing the commotion downstairs, the daughter plaintiff went outside to see what was going on. Once outside, she observed officers Matthew Mauro and Robert Orlando slamming her unarmed brother's head into a police car. She came back out with her iPad, hoping to capture the incident on video, when she was arrested by officers Mauro and Orlando. Officers Anthony Jelcic, Nicklas Yardan, and Sergeant Kevin Devine did not actively participate in the aforementioned unlawful conduct but they failed to intervene. The plaintiffs were held for almost 10 hours before being transported to Central Booking.
