Frederick and John Does 1-3. Plaintiff was a resident of Harry's Place, a men's shelter, and on January 25, 2017 Plaintiff informed NYC Department of Homeless Services and Coalition for the Homeless of violations of law occurring at Harry's Place. Plaintiff was transferred from Harry's Place a few hours later as a result of Plaintiff's reporting. On January 27, 2017 a judge signed a temporary restraining order (TRO) prohibiting transfer of Plaintiff from Harry's Place. \n\nRegardless, on February 4, 2017 Harry's Place informed Plaintiff he was being transferred and a supervisor called the police. POs Jason T. Frederick and John Does 1-3 arrived. Plaintiff showed POs the TRO but the supervisor told POs she believed Plaintiff manufactured the TRO. POs then arrested Plaintiff, applying excessively tight handcuffs to his person. Plaintiff was held in custody for over 24 hours. Plaintiff was maliciously charged with criminal trespass based on false statements submitted by Defendants. On February 5, 2017, the charges were adjourned in contemplation of dismissal.
