Demarco, Gerard Sardina, and Khamaraj Singh pushed in or otherwise loudly and forcibly broke in through the front door of the premises. The officers did not have a legal basis or justification for the entry. The officers proceeded to unlawfully seize, detain, handcuff, and arrest Plaintiff. She was then taken to the local police station. Due to the officers having placed her in handcuffs, Plaintiff suffered significant and traumatic pain in her upper arms. Notwithstanding her obvious suffering, the officers refused to provide any remedial relief, such as front-cuffing her. Officer Demarco completed arrest paperwork in which, upon information and belief, he alleged that the narcotics were recovered by officer Sardina inside the premises in such a manner as to falsely suggest that Plaintiff constructively possessed these items. Material portions of these allegations were not accurate and officers knew them to be so at the time the allegations were made. POs Demarco and Sardina were well aware that the narcotics allegedly recovered were found in a drawer in the bedroom belonging to Plaintiff’s adult son and that there was no reasonable basis to believe that Plaintiff had actual or constructive knowledge of their existence, much less actual or constructive possession. Demarco forwarded these false allegations to the DA or the criminal court in order to justify the arrest and to have criminal prosecution commenced and/or continued. As a direct result, Plaintiff was charged with criminal possession of a controlled substance and unlawful possession of marijuana.
