Early on July 5, 2012, plaintiff left the bar and walking home on Van Brunt Street. Plaintiff needed to urinate and went down a side street to relieve himself. Plaintiff saw a police car drive past and started to run. The police car followed plaintiff. When the police car put on its flashing lights plaintiff stopped running, and waited for the officers. Lopes got out of the police car, rushed towards plaintiff, and pushed him in the chest. Plaintiff fell back onto the floor. Lopes got on top of plaintiff and started punching him about his body. Dsouza began to strike plaintiff with his baton. Dsouza struck plaintiff several times, on his torso and head. Plaintiff was handcuffed. Several other officers arrived on the scene. Other officers taunted plaintiff. Plaintiff was extremely upset and began to cry. Plaintiff was taken in an ambulance to the Lutheran Medical Center. After three hours at the hospital plaintiff was taken to the 76th Precinct, and held overnight. On July 5, 2013, plaintiff was taken to Red Hook Community Center and was charged with resisting arrest, disorderly conduct and throwing or dropping offensive material onto streets and public areas.
