Officers pushed the plaintiff up against a fence and searched his pockets, and after finding half a marijuana cigarette, brought the plaintiff to the 67 Precinct. The plaintiff voiced his displeasure at being accosted and searched for no reason, and after being pushed into a holding cell, was beaten around the face and body by several officers (including Officers Dalsh Veve, Joel Crooms, and Matthew Hauswirth). The plaintiff was left with swelling and bleeding to his face and mouth, as well as a cracked tooth. The plaintiff then spent hours complaining of pain and discomfort before being taken to Kings County Hospital for an x-ray, after which he was returned to the 67th Precinct. Plaintiff was watching television when he heard a loud noise at the front door and then the door was busted down and a large number of New York City police officers entered the residence. The police officers were wearing helmets and protective gear and were carrying rams and had rifles drawn. After being instructed by an officer, Plaintiff immediately put his hands up and got on the ground with his stomach down. The officers then ransacked the house, causing damage to both the house and Plaintiff's personal belongings. One officer grabbed Plaintiff's hand, handcuffed him, and dragged him outside and placed him in the police van. Plaintiff repeatedly asked what was going on Defendant Babington stated that he received a tip that Plaintiff had a \"silver revolver\" which the Plaintiff denied. Plaintiff remained handcuffed in the police van for approximately three hours. During that time, Defendant Babington informed Plaintiff that they recovered a bag of weed under the couch and Plaintiff would have to be issued a summons. Plaintiff denied being in possession of marijuana. Defendant Babington also stated that they found suspicious powder in the bathroom which was being taken to the precinct for testing. Plaintiff again denied being in possession of any drugs.\n\nAfter approximately three hours in the van, Defendant Babington took Plaintiff back to the residence, uncuffed him, and sat him down. Defendant Babington refused to show Plaintiff a search warrant. Defendant then gave Plaintiff a summons for unlawful possession of marijuana. After Defendant Babington left the residence, Plaintiff observed that his safety vault was broken open and approximately $5,000.00 was missing as well as several personal items. He also observed damage throughout the house and to his personal possessions.
