Detectives Rogers, Elio and Mundo were previously advised to not arrest Lyons as part of the \"theft ring\" investigation. Days after her release, Plaintiff was given a December 30, 2013 Bronx District Attorney's Office Affidavit in Support of Declining / Deferring Prosecution pending a full investigation by Toys-R-Us and receipt of evidence for review. The Affidavit also stated that no corroborating evidence had been received from the co-conspirator who was arrested on December 26, 2013. As such, Detective Rogers was instructed to not arrest any additional persons and the Toys-R-Us representatives were told to provide the DA with evidence.
