Bennett, Lt. Gonzalez, and/or POs John Does 1-10 responded and confirmed through witness interviews, surveillance cameras, and physical injuries that Plaintiff was the victim. Regardless, POs unlawfully searched and arrested Plaintiff. Plaintiff was taken to the 25th Precinct, where POs negligently dropped and broke Plaintiff's cell phone. Plaintiff was criminally processed and taken to Central Booking, where he was placed in the same cell as the individual who attacked him. Plaintiff suffered severe emotional distress for the duration of his detainment at Central Booking due to the close proximity of his attacker. On November 24, 2013, after approximately 24 in custody, the District Attorney confirmed Plaintiff was in fact the victim and Plaintiff was released.
