The Plaintiff left the apartment to give his nephew's girlfriend the keys she was requesting and the Plaintiff saw NYPD officers Joshua Jimenez and Jane Doe. The NYPD officers asked to go to the apartment and the Plaintiff stayed in the apartment doorway talking with them as his sister got the nephew and girlfriend's child ready to go with the NYPD officers to the girlfriend. Jimenez and Doe became impatient and demanded to be let it. The Plaintiff informed them there were other children in there and it would be unnecessary to enter. Jimenez grabbed the Plaintiff by his left hand, spun the Plaintiff around, and slammed him to the ground. Jimenez and Doe called for backup and additional NYPD officers piled on top of the Plaintiff. Jimenez and Doe had their knees on his back while he was face down, and punched him in his left side and lower back. The Plaintiff passed out and was put into a police vehicle. After receiving medical attention, the Plaintiff was arraigned for resisting arrest and obstruction of governmental administration.
