James Ellerbe, Lt. John Costin, Det. Jamel Carr, and PO John Does 1-10 entered without probable cause, pointed their weapons directly at Plaintiff and her friend, ordered them to stand up and \"shut the fuck up\", and handcuffed them both in an aggressive and unreasonably tight manner. POs refused to loosen the handcuffs despite Plaintiff's pleas. Plaintiff informed the POs she was visiting from out-of-state, which they confirmed via her identification. Plaintiff was searched without legal justification, along with the apartment. After illegally searching for approximately 20 minutes without discovering any contraband POs nevertheless arrested Plaintiff and escorted her to the 77th Precinct, where the POs forwarded false information to commence a malicious prosecution against Plaintiff. Plaintiff was transported to Central Booking but for an unknown reason Plaintiff was not admitted there and was taken to the 97th Precinct. Plaintiff was charged with intent to sell a controlled substance even though no controlled substance was identified. A grand jury found the District Attorney did not have probable cause to prosecute Plaintiff and the case was dismissed on Marc 18, 2011. The arrest occurred after plaintiff questioned why she was being detained while smoking outside a friend's apartment and was subsequently denied the opportunity to retrieve her identification. Detective Rogers grabbed plaintiff to which plaintiff objected. In retaliation for her inquiries and refusal to submit without questioning, Detective Rogers twisted plaintiff's arms and held it there for several minutes. Plaintiff's friend was allowed to go into his house and produce plaintiff's identification. Despite producing the identification, plaintiff was handcuffed excessively tight, transported to a precinct, and strip-searched twice. Detective Rogers fabricated allegations that plaintiff had tried to burn him with a lit cigarette and resisted arrest. Plaintiff was arraigned and released on her own recognizance.
