Plaintiff opened the door and the officers proceeded to unlawfully handcuff and falsely arrest plaintiff, without probable cause or legal justification. Other defendant police officers also included DETECTIVE RYAN OLSEN, Shield No. 5992, DETECTIVE ARGELIS RODRIGUEZ, SERGEANT DANIEL BRENNAN, Shield No. 175, DETECTIVE TOMAS REYES, Shield No. 377,and Defendants New York City Police Officers John Does #s 1-10. \n\nThe officers then proceeded to unlawfully enter and conduct an unlawful search of plaintiff's room, without consent, a warrant, or any legal justification. At no time did plaintiff commit a crime or violate the law. Nevertheless, the officers falsely arrested plaintiff for involvement in a shooting that allegedly occurred in June 2020 in Brooklyn, New York. The officers transported plaintiff against his will to the 90th precinct where he was unlawfully searched, fingerprinted, photographed, interrogated, and detained in a filthy holding cell for many hours. The officers provided the Kings County District. Attorney's Office with false, misleading, and incomplete evidence to purportedly justify why they arrested plaintiff and charged him with committing crimes. Plaintiff was transported to Kings County Central booking whereas the unlawful detention continued until he was arraigned in Kings\nCounty Criminal court approximately 24 hours after he was initially arrested. Plaintiff was charged with crimes he did not commit and that the police officers lacked probable cause to accuse him of committing, including but not limited to Attempted Murder, Assault and Criminal Possession of a Weapon. The court set bail at arraignment and plaintiff was unable to post bail. Therefore, plaintiff was remanded into New York City Department of Corrections custody and detained at the Manhattan Detention Center and on Riker’s Island. Plaintiff was housed in an area where there were no correction officers present and he was stabbed in the head by another prisoner. Plaintiff was released from custody on his own recognizance on or about May 5, 2022. The arrest was done following an investigation done by the Defendant Officers. \n\nOn May 27, 2011, an attempted robbery occurred at a Metro PCS in Brooklyn. Plaintff was not connected with the robbery, but was a customer prior it occuring. Plaintiff was not in the store when the robbery happened, and Plaintiff had never stolen anything from the store. The description of the robber did not fit the physical apperance of the Plaintiff whatsoever. Plaintiff was picked out of a police staged line-up but the identification was found to be the result of unlawful suggestion by law enforcement. \n\nThere was video surveillance that Defendant Officer’s had and they knew it did not depict the Plaintiff, but the arrest was initiated against Plaintiff. The video surveillance was not disclosed in a timely manner. Still, Defendants Det. William Waldron, Sgt. Anthony Longbardi, P.O. Tomas Reyes, Lt. Michael Culkin, the District Attorney’s Office of Kings County, D.A. Charles J. Hynes, ADA Lecia Griepp, ADA Leila Rosini, ADA Lindsey Lieberman, and ADA Ernest Chem initated a criminal prosecution against Plaintiff, charging him with attempted robbery, attempted petit larceny and criminal possession of a weapon. \n\nOn January 17, 2023, the Defendants did not move forward with the prosecution and Plaintiff was released from jail. On February 4, 2013, all charges were dismissed against the Plaintiff.
