When the defendant officers examined the television, they informed the plaintiff that the television was approx. 19-inches too small for police involvement. The plaintiff was then arrested and taken to the 73 precinct while the defendants seized the television without providing a voucher. At the precinct, the plaintiff was unlawfully searched. The defendant officers met with prosecutors and said that the plaintiff was in possession of a weapon with intent to use such weapon against another and did damage the property of another person. The plaintiff could not make bail and was taken to Rikers.
