Plaintiff also worked full time for the Department of Justice and carried his shield and concealed off duty service weapon. Plaintiff was working security when the officers responded to a call at a neighboring club about a man wielding a knife. Plaintiff had seen the man pass by on the street and approached defendants to try to help them. Instead, the defendant officers yelled at the plaintiff asking where the gun was. Plaintiff showed the defendants his badge and that he had his weapon concealed. Defendants then patted plaintiff down, restrained him with metal handcuffs and unlawfully arrested him. Defendants did not recover any drugs, weapons or other contraband from Plaintiff at any time. Plaintiff was take against his will to the NYPD 13th Precinct where he was unlawfully searched, fingerprinted, photographed and detained in a holding cell. 20 hours later the plaintiff was taken to New York County Central Bookings where he was unlawfully searched, fingerprinted, photographed and detained in a holding cell. Defendants gave the New York County District Attorney's Office with the false, misleading and incomplete information that Plaintiff did a crime. On January 20, 2024, Plaintiff was arraigned in New York County Criminal Court, charged with crimes he didn't do and then was released. On February 2, 2024, all charges against Plaintiff were dismissed and sealed.
