Defendants Yu and Tomlinson arrived. Kunz arrested plaintiff for a number of charges. During the arrest, defendants tripped plaintiff, sat on plaintiff while he was on the ground, and kicked plaintiff in the face while he was handcuffed and face down on the ground. Those defendants who did not touch him, witnessed these acts, but failed to intervene and protect plaintiff from this conduct. Plaintiff suffered a Mandibular Symphysis Fracture and other injuries to his face and mouth. Defendants failed to call an ambulance to the scene to treat plaintiff's injuries. Plaintiff was taken to the 110th Precinct. Thereafter plaintiff was taken by ambulance to Elmhurst Hospital Center.
