Plaintiff rushed to Boriqua Village Senior Housing on East 138th Street in Bronx County, where she lived. Burns was especially concerned about his son Aaron because there was a Person in Need of Supervision Warrant out for him that Plaintiff had initiated. When Plaintiff arrived, he saw his two sons bloodied up from the scuffle. Shortly after, NYPD officers including Officer Crystal Zalaznick arrived and arrested Plaintiff's two sons. Plaintiff went to the 40th Precinct to see his sons and ensure they were receiving the medical treatment they needed. In the rush, Plaintiff forgot his doctor prescribed hearing aid. While Plaintiff patiently waited in the precinct lobby for nearly two hours, he did not see medical staff enter. Concerned, he went through doors leading to where his sons were held, not seeing any signs indicating the area was off limits. Due to his hearing aid not being in, he did not hear anyone inform him the area was off limits. Officer Zalaznick then came over to Plaintiff, screaming at him that he was not allowed in that area. Plaintiff tried to explain he was trying to check on his sons, and Zalaznick handcuffed him, which, due to his high blood pressure, caused him to pass out. He was treated at Lincoln Hospital for high blood pressure, then transferred to central booking at 8 pm. on 10 am on August 14, 2017, he was arraigned on criminal trespass charged and released.
