In responsive Plaintiff said in Spanish that PO Lustica was disrespecting Plaintiff. \n\nIn response, PO Lustica shoved Plaintiff, grabbed Plaintiff's hand, threw Plaintiff to the ground, and--while Plaintiff was lying face up---placed one leg on each of Plaintiff's arms to prevent Plaintiff from moving her arms. PO Lustica then repeatedly punched Plaintiff in her left eye and left face area. PO Lustica still had the key to the handcuffs in her hand and struck Plaintiff in the face and eyes with them as she punched Plaintiff. Plaintiff was incapable of protecting herself and at no time did PO Marvukaj or any other PO intervene. After the assault continued for a period of time, an unnamed PO told PO Lustica to arrest Plaintiff. Plaintiff was taken to the 46th Precinct, by which time Plaintiff's left eye was hanging out of its socket. Plaintiff was charged with assault on PO Lustica and transported to the hospital.
