On said date and time, Plaintiff was lawfully present inside vehicle and driving while in full obeyance of all traffic conditions and regulations, within vicinity of this complained-of- incident. On said date and time, Defendants then illegally approached Plaintiff in their police vehicles and signaled them to pull over using their police sirens and lights, without probable cause, reasonable suspicion, valid search or arrest warrant, or any legal justification whatsoever. Plaintiff, in response, then lawfully complied with the orders of Defendants pulled over his vehicle when said defendants then exited their police vehicles and approached Plaintiff and falsely accused him of failing to utilize a turn signal when turning. Plaintiff in response, adamantly opposed the allegations of Defendants and communicated that he was driving lawfully and used a turn signal when required but said defendants ignored or outright refused to listen to Plaintiff. Thereafter, Defendants  then illegally seized and searched Plaintiff’s person and vehicle with their outstretched hands aggressively grabbing Plaintiff about his body and rifling through his clothing, without probable cause, reasonable suspicion, valid search or arrest warrant, or any legal justification whatsoever as to the commission of a crime on the part of Plaintiff. Defendants recovered no contraband from Plaintiff or his vehicle indicating that he had committed a criminal offense. Plaintiff then lawfully questioned Defendants as to why they were arresting him but said defendants either ignored Plaintiff or blatantly refused to answer his questions. Defendants then falsely accused Plaintiff of the criminal offense and seized his person without any indication of reasonable suspicion or probable cause for commission of unlawful conduct or any justification whatsoever, grabbed him about his body and extremities before violently contorting his arms and wrists behind his back and applying excessively tightened metal handcuffs, causing plaintiff to experience significant pain and discomfort. Plaintiff complained to Defendants and requested that the handcuffs be loosened, but said defendants ignored plaintiff’s pleas. Defendants then placed Plaintiff in a police vehicle and transported him against his will to the NYPD 45th Precinct where he was fingerprinted, photographed, searched or strip-searched, questioned as to his pedigree, illegally interrogated without presence of counsel and being Mirandized, and illegally detained in a dank and dirty cell for approximately three (3) hours before being with only a traffic citation and no paperwork charging him with a criminal offense. Plaintiff was instructed by Defendant Officers to step out of the car. Defendant Officers then conducted an illegal pat-down search of Plaintiff, with no weapons or illegal contraband recovered from Plaintiff’s person. Defendant officers then handcuffed Plaintiff’s wrists tightly and ordered him to stand at the back of his car. Six additional police officers and detectives arrived on scene and questioned Plaintiff about guns, all without informing Plaintiff of his Miranda rights. Plaintiff then refused a warrantless search of car, at which point Defendant officers transported Plaintiff to the 45th precinct. Defendant officers did not inform Plaintiff as to why he was being arrested. Defendant Officers refused plaintiff’s request for medical attention for Plaintiff’s swollen and painful right wrist. On May 22, 2022, before being arraigned, Plaintiff learned from his assigned attorney that he was being charged with misdemeanor possession of a controlled substance. While Plaintiff was in custody, the Defendant Officers knowingly submitted false evidence to the Bronx County District Attorney’s Office.
