When Plaintiff's daughter had not arrived for a long period of time, Plaintiff asked officers to file a report. While waiting to file the report, officers asked Plaintiff to confirm that Plaintiff had been to his daughter's school. Plaintiff confirmed such as he was allowed to be present at his daughter's school pursuant to a court order. Regardless, officers placed Plaintiff under arrest using tight handcuffs. Plaintiff informed the officers that he had had surgery on his left shoulder recently and was in pain, however, the officers denied Plaintiff's multiple requests. During the arrest process, officers instructed Plaintiff to remove his shoelaces. When Plaintiff questioned this instruction, officers threw him to the ground and repeatedly punched him in the head, kicked his body, elbowed Plaintiff in the back of the neck, and pinned him down by using their knees. Her daughter was arrested and Plaintiff was awarded an order of protection against her. On December 12, 2017, at approximately 1:45 pm, Plaintiff's daughter broke into her home and approached her. Plaintiff yelled at her and called the police. Plaintiff suffers from hypertension and claustrophobia. Paramedics were summoned and Plaintiff entered their vehicle. As Plaintiff was being attended to, a police vehicle arrived. NYPD Officer Terrence Jones approached, when Plaintiff informed him that she had an order of protection against her daughter. Despite this, Officer Jones violently removed Plaintiff from the vehicle and placed her in handcuffs, not allowing her to show the order of protection. Plaintiff alleges an officer punched her in the face and slammed her head into a wall. Plaintiff was falsely imprisoned at the scene of the occurrence and continuing at the 47th Precinct and Central Booking.
