The signage on the cab indicated that it accepts payment by credit card. At the end of the ride, Mr. Farkas attempted to pay by credit card, but the driver indicated that he would only accept cash. Since Mr. Farkas was not carrying cash, the driver took him to an ATM machine. When they got there, Mr. Farkas tried to contact his wife to get the PIN number for the ATM. The driver called the police, and the defendant police officers arrived at their location. When the defendants began speaking to Mr. Farkas, he indicated to them that he cannot hear, and he indicated to them what had happened, and that he needed their help contacting his wife. Instead of helping him, or providing a means for him to communicate with them more effectively, the defendants grabbed him by the throat, handcuffed him, and placed him under arrest (even though they could have chosen to simply issue a criminal summons). The defendants handcuffed Mr. Farkas behind his back, even though, as a deaf person, this restrained his ability to communicate, as it stopped him from using his hands to communicate via sign language. Mr. Farkas was brought to a police precinct and placed in a holding cell, where his hands remained handcuffed behind his back. Defendants questioned Mr. Farkas about the incident, but did not provide a sign language interpreter or paper to write on or attempt to provide any other accommodation that would have allowed him to communicate.
