The plain clothed men then arrested Plaintiff Alan Schoenberg without probable cause for infringement and counterfeiting. Plaintiff Susan Schoenberg approached the commotion asking for identification which the men did not provide, so Plaintiff Susan Schoenberg attempted to return the earrings to their case at which point the men forcibly grabbed Plaintiff Susan Schoenberg by the wrist and arrested her for obstructing government administration. The store and the Plaintiffs had never had an issue with the police or been accused of infringement or counterfeit. The Defendants then commenced criminal proceedings without malicious intent. Plaintiffs suffered physical injuries as a result of the forcible arrests and physical, emotional and financially injury, as well as serious physical and emotional pain and suffering, mental anguish, shock, fright, physical pain, humiliation, trauma, debasement and embarrassment from the arrest and prosecution.
