He was falsely charged and maliciously prosecuted with assault and harassment of an NYPD Traffic Agent the previous day. On that day a male traffic agent falsely and intentionally flagged him towards the bus lane when Vanessa Jackson grabbed the Plaintiff's windshield wiper's and aggressively placed a ticket underneath. This resulted in damage to the Plaintiff's wipers and a broken clip. The Plaintiff asked why this was happening and Officer Vanessa Jackson became even more aggressive. Thereafter, NYPD Traffic Agent Luz Moctezuma began to call the Plaintiff racially discriminatory names and threatened to \"f** him up.\" The Officer then proceeded to grab his genitals before advising the Plaintiff to leave the scene. The assault happened in front of his wife and two daughters. One of the other people accused plaintiff of having taken money from him.  P.O. Christopher Rickford then questioned plaintiff about the allegation, and plaintiff said that he had run away when he saw the fight occur.  Nonetheless, P.O.s Joseph Basso and Brett Bara arrested plaintiff.  Plaintiff was denied his right to testify before the grand jury and indicted for grand larceny in the fourth degree and robbery in the second degree.  On July 2, 2014, a Justice of the NY State Supreme Court dismissed the indictment against plaintiff because he had been denied his right to testify.  The DA failed to re-present the charges within the time required by law, so the charges were dismissed and sealed on September 23, 2014. \n\nOn another occasion on March 24, 2014, plaintiff was with a friend of his who touched the hair of and began flirting with a woman they had met on the street.  Later as plaintiff and his friend were leaving a restaurant, P.O.s Travis Duke and Douglas Macewen jumped plaintiff and his friend while in plainclothes and not exhibiting their shields.  P.O. Georgette Williams had told P.O. Duke that she had seen plaintiff and his friend together when the friend tried to rob a woman's phone.  Plaintiff attempted to defend himself from P.O. Macewen's physical force, not knowing he was a police officer.  Three unmarked NYPD cars arrived at the scene, officers threw plaintiff onto the ground, handcuffed, and arrested him.  Plaintiff was indicted for assault and attempted robbery and was unable to pay the bail set for him, so he was confined to the custody of the NYC Dept. of Correction.  Plaintiff's attorney moved to dismiss the charges on speedy trial grounds.
