Plaintiff was lawfully present on the sidewalk, while bearing no physical similarities to the aforesaid suspect and wearing a jacket that did not fit the description of vicinity of this complained-of-incident when plaintiff was unlawfully searched, arrested with excessive force and charged with a crime by defendants.
