At approximately 6:30 AM, Plaintiff Rafael Paulino was asleep on the living room couch when he was approached by Defendant Police Officers, including Defendant Brian Fleming and Defendant Anthony Diaz. The Defendants threw him to the ground, handcuffed him from the back, and proceeded to punch, kick, and otherwise physically abuse him. They eventually removed him to the precinct and then to Central Booking, where he was charged with Criminal Possession of a Controlled Substance in the Seventh Degree, Criminally Using Drug Paraphernalia in the Second Degree, and Resisting Arrest, all of which are A Misdemeanors. This was based on the allegation that Cocaine residue was found in the bedroom of the Plaintiff's brother. Plaintiff Modesto Paulino was also woken up by the Defendants on the night of January 12, 2012, assaulted and arrested in front of his pregnant wife, and charged with Possession of Narcotics. He was also taken to Central Booking for processing. Both Plaintiffs had protested their innocence after they were arrested.\n\nPlaintiff Rafael Paulino was released at arraignment and given a court date. After going to court several times, his charges were dismissed on February 21, 2013. He was incarcerated for approximately 34 hours. Plaintiff Modesto Paulino was not released at his arraignment and spent approximately 150 days in jail.
