They stated they were investigating an alleged violation of Gov Cuomo's executive order prohibiting non-essential gatherings during the Covid-19 pandemic. Ms. Bizzel received a call from Mr. Calvin Brown, the business owner, who stated he was/would watch everything from the security cameras, which NYPD officer John Doe then unplugged. The officers then began searching the premises without a warrant, and claimed to have recovered a loaded 9 mm handgun, and arrested Ms. Bizzell, Mr. Johnson and Mr. Shenery. Mr. Brown's father, Mr. Peterson arrived at the juice bar having been called by a friend about the NYPD presence at his son's business, where the NYPD arrested him as well. All four individuals were held at the 25th Precinct. On May 3, 2020 , the Plaintiffs and Mr. Shenery were told they had been arrested on firearm possession charges. That day, NYPD officers returned to Teamworkon3 and allegedly found a loaded derringer.
