Officers arrived at Plaintiff house, and Plaintiff refused to go outside or let them inside. Irritated, the Individual Defendants proceeded to enter through a neighbor's home, jump the fence, and break in through Plaintiff's kitchen. The officers had no lawful authority to enter the home - neither a warrant nor exigent circumstances existed at the time of entry. Several of the Individual Defendants entered the first floor of the home with their guns drawn and proceeded upstairs. Officers immediately placed Plaintiff under arrest. \n\nAt the same time, the remaining officers entered a second bedroom next to Plaintiff's, where the friends were hanging out. Plaintiff's dog was also in the second bedroom. Immediately after entering the second room, one or more of the individual Defendants shot and killed PLaintiff's dog without justification. Plaintiff, cuffed in the room next door, heard the shot and the dog's cries of pain. One of the officers, likely Officer Forman, told Plaintiff during transport back to the precinct that his dog attacked one of the officers, but this was a lie, or false information passed on from the officer who pulled the trigger. The neighbor called the police, and a squad of several officers (referred to as John and Jane Does) swarmed Plaintiff. Without identifying themselves, they arrested Plaintiff and one PO, Officer Welch, grasped and threw Plaintiff into the street. Officers John and Jane Doe(s) handcuffed Plaintiff, and Welch placed his knee of Plaintiffs right arm painfully under his body weight, causing Plaintiff to scream and alert the officers of the pain to his arm. Welch ignored and pushed harder, causing Plaintiff's arm to break. Plaintiff was brought for a check on his arm at Wycoff Hospital, however Welch refused any treatment for Plaintiff and moved him to the Precinct for processing.
