Plaintiff was approaching 54th Street and 5th Avenue, where he intended to turn left onto 5th Avenue, when he was stopped by Officer Larregui at the intersection of 54th Street and 5th Avenue. Officer Larregui demanded Plaintiff's license and registration, and five seconds later attempted to open Plaintiff's locked door. Approximately four seconds after that, Plaintiff gave Officer Larregui his license and registration, at which point Officer Larregui instructed him to put the car in park, reached into Plaintiff's car through the driver's side window, and pushed Plaintiff's left shoulder backwards. Officer Larregui then agreed to allow Plaintiff to turn left and park on the southeast corner of East 54th Street and 5th Avenue. Officer Larregui followed Plaintiff to this spot while screaming \"let's go, let's go.\" Once parked, Plaintiff requested that Officer Larregui allow Plaintiff to speak with his supervising officer, at which point Officer Larregui requested backup for an \"irate motorist.\" Plaintiff stated that he would remain seated in his car until Officer Larregui's supervisor arrived. Officer Larregui physically removed Plaintiff from his car, handcuffed Plaintiff, and began to punch Plaintiff repeatedly in the face and head. At least one of these punches was captured on Officer Larregui's body camera. Over one dozen officers responded to Officer Larregui's request for backup after the assault, including Sergeant Coston, Sergeant Semioli, and Officer Valand. Officer Larregui informed Sergeant Coston that he hurt his finger punching Plaintiff in the head, and Officer Larregui asked Officer Valand if he could seek medical attention for his injury. Sergeant Semioli and Sergeant Coston both observed Plaintiff crying after the incident and turned Plaintiff so he was facing toward the street, and Sergeant Semioli can be seen laughing at Plaintiff in Officer Larregui's body camera footage. \n\nFollowing the incident, Plaintiff was taken to the 18th Precinct, where his cellphone, social media accounts, and text messages were searched by Officer Larregui. After Plaintiff was processed at the 18th Precinct, Sergeant Coston walked him out of the building to transport him to Manhattan Central Booking. At this point, Sergeant Coston instructed Plaintiff to decline medical attention when he arrived at Central Booking. Based on Officer Larregui's account of the incident, Plaintiff was charged with Resisting Arrest. Against NYPD policy, Officer Larregui did not upload the body camera footage of the incident, and when he was asked to do so he claimed his camera was malfunctioning. Valand, began banging on the driver’s side window of Plaintiff’s vehicle. Valand, not in a police uniform, told Plaintiff he was a police officer but did not produce a police badge. Valand asked Plaintiff for his driver’s license, which Plaintiff produced. Valand asked Plaintiff to step out of his car and told Plaintiff that he was going to search Plaintiff. Numerous other plain-clothes defendant officers descended on the scene and without Plaintiff’s consent, began rummaging through Plaintiff’s vehicle, throwing his belongings about. The officers continued impermissibly searching Plaintiff’s person, revealing Plaintiff had a utility knife in his pocket, which Plaintiff had been using to tape his bicycle. Plaintiff was ordered to the back of his vehicle where he was handcuffed and placed under arrest. Following an extended stay at the precinct, Plaintiff was transported to Central Booking for arraignment. After arraignment, Plaintiff was transported to Riker’s Island. After spending about 24 hours at Riker’s Island, Plaintiff was taken to Elmhurst Hospital. After spending a few days at Elmhurst Hospital, Plaintiff was transported to Bellevue Hospital where he spent about thirty days.
