Video footage shows Plaintiff trying to get up off the ground and avoiding escalating the situation. PO Gloria Cevallos and Minator Kryeziu then arrived at the scene and tried to handcuff Plaintiff while he was still on the ground, without first announcing themselves or asking any questions. A confused Plaintiff attempted to stand up from the sidewalk while PO Cevallos held his arms behind his back. PO Kryeziu then grabbed him, slammed him to the ground, and punched him in the face at least three times. As a result of this unprovoked attack, Plaintiff lost consciousness and his face bled profusely. PO Cevallos and Kryeziu started dragging Plaintiff’s limp body towards a squad car. Four additional PO –Jorge Malavet, Racquel Palmer, and two unknown officers – arrived and joined PO Cevallos and Kryeziu in dragging Plaintiff’s body to the car, causing further injuries. \n\nPlaintiff was wrongfully imprisoned and spent two nights in jail. PO Cevallos fabricated information, based on which Plaintiff arraigned in state and federal court. However, video footage from the incident showed that the charges against Plaintiff were false, and that he had been violently attacked by the officers. On November 3, 2021, the federal charge against Plaintiff was dismissed by consent of the parties. Hernandez wherein plaintiff allegedly agreed to pay Hernandez money in return of a sex act. While POs, potentially including John or Jane Does 1-10, were speaking to Plaintiff's friend PO Palmer unlawfully ordered Plaintiff to get off his phone. Plaintiff refused to do so. PO Palmer called additional officers over and again ordered Plaintiff to get off his phone. As Plaintiff attempted to explain he did not think he needed to do so POs grabbed for the phone and began to punch and choke Plaintiff, ultimately dragging him from the vehicle and injuring him so severely an ambulance was called. While they waited for the ambulance POs affixed metal handcuffs to Plaintiff's wrists in an excessively tight fashion and left him face down on the pavement in open view of the public. POs Silva and Palmer targeted Plaintiff due to Plaintiff's race. \n\nPlaintiff's injuries required hospitalization. On his release he was sent to Central Booking, processed, and unlawfully arraigned for resisting and criminal possession of a knife, though at no point did Plaintiff resist or posses a knife. PO Silva signed a false criminal complaint against Plaintiff, fabricating that Plaintiff refused to provide identification and attempted to drive away. POs caused this malicious prosecution to be initiated in order to enact retribution for perceived disrespect from the Plaintiff, for overtime compensation, and other illegitimate reasons.
