After the plaintiffs were leaving a funeral together in Michael Thomas's vehicle, Thomas was pulled over by the defendant officers, who falsely claimed that Thomas had made an illegal U-turn. Upon being stopped, the officers ordered the plaintiffs out of the vehicle and searched the vehicle, as well as, the plaintiffs themselves. The officers then falsely claimed they had recovered firearms, one from within Thomas's vehicle and another from the person of Anthony Alston. The officers then arrested the plaintiffs with multiple charges of criminal possession of a weapon. Officer Palminteri signed off on the criminal complaints against each plaintiff, wherein he alleged that he had been informed by Officer Cooley that Cooley had recovered a loaded firearm from underneath the driver's seat of Thomas's vehicle. The officers grabbed all four Plaintiffs and placed them in handcuffs before taking them to the 79th Precinct and Kings Country Central Booking. Plaintiff Kirkman was released at Central Booking, but the other three Plaintiffs were held in custody for approximately 24 hours after the Defendant officers provided the District Attorney's Office with false, misleading, and/or complete information that the Plaintiffs committed trespass.
