The plaintiff declined to allow the officers to search his vehicle, and he then had a medical emergency. While the plaintiff was being treated for his medical condition, the officers took the keys to his vehicle and started to unlawfully search the vehicle, where they found a toy gun. The officers officers charged plaintiff with “Possession of an Air\nGun” prosecuted the plaintiff.
