RICE and DIAZ stopped the Plaintiff's friend’s driving car while the Plaintiff was a passenger in the vehicle's front passenger seat. Both parties were wearing seatbelts, and Plaintiff’s friend was driving the car in compliance with all vehicle and traffic laws. Nevertheless, P.O. RICE and DIAZ stopped and asked for the Plaintiff's friend’s driver's license.  P.O. RICE and DIAZ told them that the license was suspended. The plaintiff had no idea about the suspension of the driver's license.   P.O. RICE and DIAZ asked the Plaintiff to step out of the vehicle and search for the Plaintiff. Without finding any contraband, P.O. RICE and DIAZ retrieved Plaintiff’s personal belongings with his bag. When Plaintiff asked to return his belongings, P.O. RICE and DIAZ unlawfully pinned Plaintiff’s hand behind his back and handcuffed Plaintiff in the absence of probable cause or reasonable suspicion. After remaining 19 hours at Central Booking, the Judge released him.
