Police officers only had a valid search warrant for the ground floor, which was being rented by another person. Nevertheless, officers searched Plaintiff's apartment and found a prescription bottle for Endocet, which Plaintiff had been prescribed by his primary care physician. The officers then arrested Plaintiff and falsely stated to the DA that Plaintiff had committed the crime of Criminal Possession of a controlled substance. After 24 hours in police custody, Plaintiff was arraigned & charged. After being released from custody, Plaintiff went back to his apartment, discovering the officers serious property damage as a result of the officers' search. Additionally, two World War Two antique radios had been taken from his apartment, which were valued at approximately $5,000.
